City agrees to settle with Mountain Park Homeowners

Carson City supervisors voted 4-1 Thursday to settle with Mountain Park homeowners, and agreed to pay the group $100,000 in cash and allow a storm-drain system to be built to cope with potential flooding.

The settlement was discussed in closed session, where liability questions were hashed out, said Mayor Ray Masayko. He said nothing further about the matter, but voted against the settlement.

"With the taste of spinach in my mouth, I move to approve the settlement,"

said Supervisor Richard Staub.

Homeowners in the Mountain Park neighborhood joined in a class-action suit against Stanton Park Development, Inc., Garretson-Furgerson Construction Co., Millard Realty and Construction and the city after finding excess water in the crawl spaces of their newly constructed homes.

Of the 500 homeowners, 350 joined the suit. Only those involved in the suit

will benefit from the $14 million in total settlement money, which will pay

for a storm-drainage system and other repairs.

The city also agreed to maintain the drainage system and waive fees for the installation project.

The settlement agreement must now be approved by a Carson City District Court judge.
