LAS VEGAS (AP) - The Nevada Democratic Party is siding with the state in a legal tussle over how to fill a vacant U.S. House seat.
Lawyers representing Democrats in Nevada and Washington submitted a court filing Thursday opposing a state Republican party lawsuit challenging the rules of the special election.
Democratic Secretary of State Ross Miller announced earlier this month that the state's first special election to fill a House vacancy will be determined by an open contest Sept. 13.
The unprecedented election will fill a seat vacated by Republican Dean Heller. There is no primary.
The state Republican Party lawsuit says political parties should pick the nominees.
Democrats support Miller's ruling.
Heller on Monday took the U.S. Senate post formerly held by Republican John Ensign, who resigned.
