Holley found guilty of assaulting officer

Daniel Holley, 39, will be sentenced to up to a year in prison March 26 following his conviction on charges of assaulting a peace officer.

The incident happened after deputies were called to his residence Sept. 30 when a neighbor reported a loud disturbance. His girlfriend Laura Bryte said he was intoxicated and had caused a disturbance but had left the scene before they arrived.

They were called back a short time later when Holley returned and threatened to break in.

Again, Holley was gone when they arrived but returned as officers were about to leave.

When he was ordered to stop, Holley instead took a boxing stance and charged Sgt. Earl Mays. The sergeant side stepped and Holley fell down, but got up and charged again. Deputies had to subdue him to cuff him.

Holley testified he was so intoxicated he didn't know what he was doing and didn't know the deputies were police officers. The jury returned a guilty verdict Friday.
