Man gets 10 years in shooting death

David Michael Grimes, 33, was sentenced Tuesday to the maximum penalty of 10 years for voluntary manslaughter.

Grimes was dropping off his son at his ex-wife’s home when he got into an argument with her new husband, James Lay, on Feb. 3, 2013.

The argument turned into an altercation inside the home. The parties were separated before another altercation outside the home that ended with Grimes pulling a pistol and shooting Lay.

Lay died on the way to the hospital from a bullet wound in the chest.

“The district attorney’s office through this prosecution and the court through this sentence sent a clear message that violence, particularly when children are involved, will not be tolerated,” said District Attorney Neil Rombardo in a statement.

Judge James Wilson made clear during sentencing that people must be deterred from bringing firearms to a child exchange between parents.

Grimes was arrested several hours after the shooting when he turned himself in. Sheriff’s reports indicate Lay was extremely intoxicated the evening of the fight on Super Bowl Sunday.
